ANA Legislative Update as of August 2, 2008

With the support of the Board of Governors, President Barry Stuppler created the ANA Government Affairs Committee and appointed Mark Olanoff and Diane Piret as co-chairs.  Mark Olanoff has 10 years of lobbying experience at the federal and state level.  Diane Piret has been an Industry expert for over 20 years and currently is employed by the Industry Council for Tangible Assets (ICTA).

Short Title:  Cents and Sensibility Act
Purpose:  Revises the discretionary authority of the Secretary of the Treasury to prescribe the weight and the composition of the alloy of the one-cent coin.

Short Title:  Numismatic Rarities Certainty Act of 2007
Purpose:  To amend title 31, United States Code, to provide a clear line of demarcation with regard to private ownership of any coin, medal, or numismatic item made or issued by the United States Government before January 1, 1933, and of any piece produced by the United States Mint before such date, that is not in the possession of the United States Government, to establish requirements with respect to the inventory of certain United States coins, medals, numismatic items, and other pieces produced by the United States Mint that are owned by the Department of the Treasury, and for other purposes.

Short Title:  Tax-Free Gold Act of 2008
Purpose:  Prohibits the imposition of tax on any coin, medal, token, or gold, silver, platinum, palladium, or rhodium bullion issued by any person or jurisdiction.  Prohibits states from assessing any tax or fee on any currency or other monetary instrument that is used in interstate or foreign commerce and that is subject to the enjoyment of legal tender status under the U.S. Constitution.

Purpose:  Requires quarter dollars, issued beginning in 2010, to have designs on the reverse emblematic of one national site in each state, the District of Columbia and territory of the United States.  Instructs the Secretary of the Treasury to select in each state a national park or other national site to be honored with a coin. Requires five coin designs in each year of the period of issuance.  Instructs the Secretary to strike and make available for sale silver bullion coins that are exact duplicates of such quarter dollars.  Authorizes the Director of the National Park Service to purchase for resale or distribution numismatic items issued under this Act.

Bill Number:  HR 2358
Short Title:  Native American $1 Coin Act
Purpose:  Directs the Secretary of the Treasury to mint and issue $1 coins in commemoration of Native Americans and important contributions made by Indian tribes and individual Native Americans to the development and history of the United States. Requires, effective beginning January 1, 2008, that such coins have designs: (1) on the obverse bearing the " Sacagawea design;" and (2) on the reverse bearing images celebrating important contributions made by Indian tribes and individual Native Americans to the history and development of the United States. States that, if the date of the enactment of this Act is after August 25, 2007, such design shall be implemented beginning January 1, 2009.  Requires edge-incusing of the inscriptions "E Pluribus Unum" and "In God We Trust" in a manner that preserves the distinctive coin edge so that its denomination is readily discernible, including by individuals who are blind or visually impaired.  Requires the number of $1 coins minted and issued in a year with the Sacagawea-design on the obverse to be not less than 20% of the total number of $1 coins minted and issued in such year.  Instructs the Secretary of the Treasury to carry out an aggressive, cost-effective, continuing campaign to encourage commercial enterprises to accept and dispense $1 coins that have the so-called "Sacagawea design."

Short Title:  Exhibitors - Licensure - National Convention Exemption
Purpose:  Specifying that the exemption from the trader's license requirement imposed on exhibitors applies to exhibitors that provide the promoter with an affidavit stating that the exhibitor has not participated in more than three shows, not including participation in a specified national show, in addition to the current annual income requirements.
